Sorry guys. It is not illegal to fly a drone above this or any other area in Florida.

It is illegal to fly them over populated areas. A construction site during work hours is a populated area.

No it's not, there is an FAA guideline about not flying it directly over a person but in a generally populated area there is no guideline. On top of that, there is significant debate about if that guideline is even enforceable.

Issues Still Unanswered
In the years to come, further rule-making will doubtless address some or all of the following questions, and probably more:

  • What constitutes a flight “over people?” Directly overhead, or not?
  • Should special regulations cover using drones to gather information about people, as opposed to weather, crops, and so on?
  • How should drones be used for emergency situations, such as search and rescue?
  • How can drones be used by the various agencies and departments in charge of weather forecasting (NOAA, the Navy, and the National Science Foundation)?
Many additional unanswered questions were raised by the FAA regulations. Will the registration requirement be retroactive? Will it apply to a build-it-yourself drone? Many drones are homemade, and even commercially-purchased ones can be taken apart so that their parts can be swapped out. At what point does the drone become a different drone, needing new registration? How will the FAA enforce the registration requirement?

I personally interpret the rule as above a populated area because it is difficult to determine when it is directly above a person. Either way, I believe a responsible drone owner should avoid any chance that they may be breaking the law.

The entire Walt Disney World resort and areas out by the Space coast are designated as Restricted no-fly zones, so yes, there are areas in Florida where it's illegal. And that's just off the top of my head.

I would assume the same person that did the previous 4k drone video a few months back, no idea who it is though.

But regardless and this is to everyone, lets just appreciate someone got some awesome footage and lets not turn this into a drone/quadcopter regulation thread yeah?

I spent way too long at that trying to figure out why somebody was in trouble. I figured somebody had sneaked into the construction site to take photos or somebody working there did.

DAK is in a separate county, so that very well could be, I just know that most of WDW is designated no-fly zone.

Maybe because the "awesome footage" shouldn't really exist. No reason to go flying drones over theme parks.

No fly zones don't apply to drones if the following guidelines are followed.
  • Aircraft must weigh less than 55 lbs. (including any attachments such as a camera)
  • Aircraft must be registered and marked
  • Fly below 400 ft.
  • Fly within visual line-of-sight
  • Fly in clear weather conditions

So a drone could fly at an airport if it follows those rules?

Private property includes air space up to 500 feet (which is also why minimum altitude for aircraft is 500ft). You must have permission from the owner to fly over their property, Universal has explicitly said flying drones over their property is not allowed. Seeing that drones cannot go above 400 feet, drones are not legally allowed over Universal Parks.
